Ear Hero Sales Inc. 30 Day Return Policy

We understand that as with any product sometimes it is not the right fit.  If you are not satisfied with any of the earHero products simply send us an email at [email protected] with the reason you are not satisfied and your order number and we will respond with return shipping instructions.  The product must be in new condition including all packaging.  If product is returned within the 30 day return policy without all original packaging in new condition it will be subject to a 30% restocking fee.  Shipping cost cannot be recovered so we can not refund shipping costs or issue return shipping labels.

Ear Hero Sales Inc. Limited Warranty Policy

All Ear Hero proprietary products have a Limited 90–day Warranty for defects in the product caused by the material or the workmanship, extended only to the purchaser of the product. If you think you might be eligible for a replacement, please contact us for help at [email protected] to determine if you are in fact eligible. If you are eligible, your product will be repaired using new parts or you will be provided with a new product at Ear Hero Sales discretion. All warranty products must be received by earHero warranty department prior to 90 days from date of purchase and require proof of purchase in order to qualify for warranty repair or replacement. While you will be responsible for the cost of shipping the product to us, we will cover the cost of shipping the repaired or replaced product back to you.

This warranty only covers defects in the materials or workmanship that appear through normal usage. Defects or damages that appear because from other causes, which include but are not limited to, commercial use, theft, vandalism, misuse, excessive moisture, ear wax, improper maintenance or storage, alternations of the product not authorized by Ear Hero Sales Inc. or acts of God, are not covered by this warranty.

This warranty guarantees that there will be no defects the product as a result of materials or workmanship for 90 days from the date of purchase and expires at the end of the 90 days from the purchase date.

This warranty is only eligible in the country of purchase.

Other than the limited warranty, there are no express warranties. Where permitted by law, any implied warranties, condition of merchant ability, and fitness for a particular purpose are limited to the duration of the limited warranty (90 days). Also where permitted by law, under no circumstances will Ear Hero Sales Inc. be held responsible for any incidental, special, consequential, exemplary, punitive, or indirect damages, even if Ear Hero Sales Inc. was aware of the possibility of such damages in advance.

Certain states and jurisdictions do not allow the limitation or exclusion of indirect damages or the limitation of the length of an implied warranty, so the limitations or exclusions described above may not apply to you. Repairs after warranty period has expired

Rest assured that we will take care of you after the Limited 90–day Warranty period has expired.  Should your earphones break you have the option to purchase a repair.  This repair will return your earphones to like new condition and include a new 90-day limited warranty.  Simply Click Here to purchase a repair.  Once you have purchased the repair you will receive confirmation of your purchase with return shipping instructions. Please mail your broken set of earHero’s back to us with a copy of your receipt for the purchase of the repair.  Shipping back to you will be added to the repair price automatically. Out of warranty repair is currently only available in US.  Please contact us with any questions.

Shipping Policy

We use USPS flat rate shipping in order to keep the cost down and deliver the product as fast as possible with tracking.  Typically deliveries in the US arive within 3 days of the shipping date.  Orders received during business hours are typically shipped out the next business day, and orders ordered on Friday or over the weekend will be shipped the following business day.  Due to past fraud we request shipping to the same address as your billing address. If this is not possible we may contact you for verification.

International Shipping Policy

At this time we have chosen to ship only in the USA and are working to set up distributors in other areas of the world. If you are interested in purchasing earHero products and live outside the US please send us an email and we will let you know if we have a distributor in your area.

 

Product Liability Statement

SAFE USE OF EarHero: The Product is intended for use as an in-ear audio delivery system, more commonly referred to as earphones. The Product is promoted for use while radio monitoring or exercising. Thanks to the patented design of the Product’s earpiece, you can monitor your radio communications or listen to all of your favorite tunes, podcasts or audiobooks, and still hear ambient noise & sound around you. The intended use of the Product is to provide a chosen audio feed while also allowing for improved and clearer hearing of outside noise sources.

PLEASE NOTE

You remain responsible for your safety in all activities while using the Product as intended. While exercising using the Product, you are responsible for ensuring that you are able to hear all surrounding sounds with sufficient clarity to enable you to exercise safely to avoid any hazard which may cause you injury or harm.

RISK WARNING:

Use of the Product does not in any way guarantee your safety while exercising or conducting activities using the Product. The use of the Product in an unsafe manner (such as in circumstances where you are not able to clearly hear sounds around you) may result in you suffering damage, injury and even death. Ear Hero Sales Inc can not responsible for the volume at which you listen to you device and you understand that listening to loud music or voice for extended periods of time can damage your hearing. Ear Hero Sales is not responsible for hearing loss or tinnitus.

WAIVER AND RELEASE:

Before using the Product, and as a condition of starting to use the Product, you acknowledge and agree that: You have read and understood the safe use and risk warning statements detailed in this document. Use of the Product is at you own risk, and you acknowledge and accept the above risk warning. To the extent permitted by law, you indemnify and release Ear Hero Sales Inc.(including in its capacity as trustee of its distributors ), it’s directors, officers and any related entities from and against any claims of any kind (whether at tort, contract or statute) including personal injury, death or property damage, however caused (including negligence) and arising out of your use of the Product in any unsafe manner or in a manner which you should reasonably have foreseen would result in injury, death or damage. Except for those consumer guarantees set out in the United States Consumer Laws, and otherwise as required by law, Ear Hero Sales Inc. disclaims all other warranties, whether express or implied, relating to the Product and your use of the Product. Subject to Ear Hero Sales Inc’s obligations set out in the United States Consumer Laws and any other applicable laws which cannot be excluded, modified or restricted at law: Ear Hero Sales Inc’s liability to you for any other problem, risk or fault shall be limited, at Ear Hero Sales Inc’s election, to one of the following options: the repair of the Product, where the cost of return postage is your responsibility; or where the Product is deemed incapable of repair (at Ear Hero Sales Inc’s sole discretion), Ear Hero Sales Inc may choose to either replace the Product or a refund the cost of the original purchase. Ear Hero Sales Inc’s obligations under this clause does not extend to normal wear and tear, or any damage caused wholly or partly due to an event or cause beyond the reasonable control of Ear Hero Sales Inc, including without limitation each of the following: use the Product otherwise than as intended; or accidental or intentional damage.
